Terms and Conditions

Please read these Terms and Conditions carefully before placing an order.

These Terms govern the purchase of Goods from D65. By ordering from our website, you agree to be bound by them.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to purchase Goods from us.


3. Definitions

  • Goods means the pre owned cameras, lenses, and accessories sold on our website.
  • Consumer means an individual acting wholly or mainly outside their trade or profession.
  • Contract means the agreement formed when we confirm your order.
  • Website means www.d65.co.uk.

4. Nature of Goods

All Goods sold by D65 are pre owned vintage photographic equipment, often several decades old.

Vintage equipment differs fundamentally from newly manufactured products. While we inspect, service, and prepare items prior to sale, they may show signs of age, previous use, cosmetic wear, and operational limitations consistent with their original design and manufacture.

By purchasing from us, you acknowledge that you are buying vintage equipment and accept the characteristics and limitations associated with such products.


5. Product Descriptions and Condition

We aim to describe all Goods honestly, clearly, and in good faith.

Each listing includes:

  • Photographs of the actual item for sale
  • A written condition description
  • Notes on cosmetic wear, operation, and known limitations

Condition grading reflects our professional assessment at the time of listing and is subjective. Minor marks, wear, or characteristics consistent with normal vintage use are not defects.

You are responsible for reviewing all photographs and descriptions before purchase. If anything is unclear, you should contact us before ordering.


6. Vintage Functionality and Limitations

Due to their age, vintage equipment may:

  • Contain original or period correct mechanical or electronic components
  • Use legacy wiring, meters, capacitors, shutters, or batteries
  • Be subject to wear, drift, or failure over time

Not all age related issues are predictable or preventable. Age related degradation and inherent limitations of vintage technology are not considered defects.


7. Servicing and Preparation

Where stated, Goods are serviced and prepared prior to sale. Servicing improves reliability but does not make vintage equipment equivalent to new products.

Unless explicitly stated, servicing does not constitute a full manufacturer style overhaul and does not guarantee indefinite performance.


8. Orders and Contract Formation

Product listings do not constitute a contractual offer. A Contract is formed only when we confirm your order by email.

We reserve the right to refuse or cancel orders where necessary, including due to errors, stock availability, or suspected misuse.


9. Pricing and Payment

All prices are shown in GBP and include VAT where applicable. Payment must be made in full before dispatch.


10. Delivery

We aim to dispatch orders promptly. Delivery times are estimates and not guaranteed.

Risk passes to you once Goods are delivered. You should inspect items as soon as reasonably practicable after delivery.


11. Use, Misuse, and Third Party Repairs

We are not responsible for faults or damage caused by:

  • Misuse, neglect, or improper handling
  • Exposure to moisture, impact, or environmental damage
  • Use of incorrect batteries, film, or accessories
  • Repairs, modifications, or servicing carried out by third parties

Once Goods have been altered or repaired by anyone other than us, responsibility for subsequent issues rests with the buyer.


12. Returns and Cancellation

You have the right to cancel your order within 14 days in accordance with consumer law.

Returned items must be in the same condition as supplied. Deductions may be made for loss in value caused by unnecessary handling beyond what would be reasonable in a retail environment.

Return shipping costs are the responsibility of the buyer unless otherwise stated.


13. Conformity and Consumer Rights

We have a legal duty to supply Goods that conform to the Contract.

For vintage Goods, conformity takes into account:

  • Age
  • Pre owned status
  • Descriptions and photographs provided
  • Reasonable expectations of vintage equipment

Goods are not considered non conforming due to normal wear, cosmetic marks, age related limitations, or inherent characteristics of vintage technology.


14. Guarantee and Remedies

Goods are covered by our stated guarantee.

Where a fault arises within the guarantee period, our responsibility is limited to repair, replacement, or refund, at our discretion and in line with consumer law.

We do not offer compensation for loss of use, inconvenience, or consequential losses.


15. Safety and Assumption of Risk

Vintage equipment was manufactured to historical standards and may not meet modern safety or regulatory requirements.

By using the Goods, you accept the inherent risks associated with vintage mechanical and electronic equipment when used reasonably and for their intended purpose.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence.

Subject to this, we are not liable for injury, damage, or loss arising from inherent characteristics of vintage equipment, age related failure, or foreseeable limitations of legacy technology.


16. Limitation of Liability

We do not exclude liability for fraud or fraudulent misrepresentation.

Subject to this, we are not liable for losses that were not reasonably foreseeable at the time the Contract was formed, or for losses arising from use of the Goods outside normal photographic purposes.


17. Governing Law and Complaints

These Terms are governed by the law of England and Wales.

If you have a complaint, contact us at support@d65.co.uk. We aim to respond within five working days and resolve issues fairly.


18. Attribution

These Terms replace any previous terms and are tailored specifically to the sale of pre owned vintage photographic equipment.
